Terms of Service
These terms govern your use of the NobleNewt platform, operated by NobleNewt LLC ("NobleNewt", "we"). By using NobleNewt, including an online store built on NobleNewt or the NobleNewt Studio admin app, you agree to them.
The service
NobleNewt provides software for independent merchants to run online stores, orders, customers and marketing. Each store is operated by its merchant, who is responsible for its products, prices, policies and customer service.
Accounts
You are responsible for the information you provide and for activity under your account. Keep your sign-in details and codes private, and tell us right away if you think someone else has used your account.
Acceptable use
Do not misuse NobleNewt: no unlawful activity, fraud, spam, attempts to access accounts or data that are not yours, or interference with the service.
SMS terms: NobleNewt sign-in codes
- What you get: one-time passcodes for your account at online stores built on NobleNewt. After you add your mobile number to your store account and agree to receive codes by text, we send a code to verify the number, a code when you ask to sign in by text, and a code at sign-in if you turn on two-step verification. We send nothing else to your number.
- How often: one message per code you request. Message frequency varies.
- Cost: message and data rates may apply.
- Help: reply HELP for help, or email garrett@noblenewt.com.
- Opt out: reply STOP to stop receiving texts. We will send one confirmation and then no more texts unless you sign up again.
- Carriers: carriers are not liable for delayed or undelivered messages.
- Privacy: see our Privacy Policy. Mobile numbers and SMS opt-in consent are not shared with third parties or affiliates for marketing or promotional purposes.
Fees
Fees for merchants are set in their NobleNewt plan or agreement. Shopping at a store is subject to that store's prices and policies.
Disclaimers
NobleNewt is provided "as is" and "as available". To the extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise the service will be uninterrupted or error free.
Limitation of liability
To the extent the law allows, NobleNewt is not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid NobleNewt in the 12 months before the claim, or $100 if you paid nothing.
Ending use
You can stop using NobleNewt at any time. We may suspend or end access for anyone who breaks these terms or puts the service or others at risk.
Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict of law rules.
Changes
We may update these terms. We will change the effective date above and, for significant changes, give notice through the service.
